You can ask what you want.

They don't have to agree to your request though.

If you want them out, you need to make sure your wallet can afford it - if they have any sense they'll only move after an extremely generous offer.
 
As Proserpina said, of course, you can ask. However, don't expect them to "evacuate" cheap (if at all).

Ask them to "evacuate"...hmmm, asking is never a problem.

How long would they be expected to comply with the "evacuation"?

Are you the REFUGEE?

Seriously, in CA, you betcha its legal.

Why, oh why in the name of anything that resembles fairness, would anyone ever pay money to OWN a home; only to VEST control and become a serf to a band of "peasant", "pretend" FEUDAL LORDS?

When you buy a property under the "command & control" of any HOA, you have sold yourself into slavery.

You have ONLY yourself to blame.

I guess in the minds of some sheeple, being controlled by some slick, urban politricksters, isn't as controlling as being more tightly controlled, owned, and governed by an HOA!!!
