Is it legal to advertise a mop attachment for Dyson? (attachment is not made by Dyson) Purchase & Sale

    Hello,

    We want to sell a mop attachment for Dyson vacuum cleaners in the USA via Facebook marketing. This attachment is not made by Dyson, it's made by our company. Of course, we would state that it is not made by Dyson.

    1. Is it legal to use the Dyson brand name on our website (e.g. compatible for Dyson V15) + product photos where you can see a Dyson that is attached to mop attachment?
    2. Is it legal to show a Dyson vacuum cleaner in the Facebook advertising video?

    Likely trademark infringement that can get you sued.

    But don't take my word for it. Ask an attorney.

    You might have to buy a license from Dyson to use the name and image to sell your products.

    Try making the mop attachment more universal to fit other brands.

    It's a very fine line to draw here, and it will depend, to some extent, on exactly how you advertise it. For example, "VACUUM MOP ATTACHMENT," with a reference to a particular brand in the description, might fly. On the other hand, if you prominently mention a particular manufacturer, you're likely going to receive a C&D letter. Do you have the money to wage a legal battle with a company that sells vacuum cleaners at prices that suggests they're made of gold?
