Consumer Law, Warranties Is a consumer credit contract in the name of 2 people(that is only signed by 1)valid?

We have a consumer credit contract which is in the names of my husband and I but was only signed by me. Is this a valid and enforceable contract?

In the "first name" blank it says "myname & hisname" exactly like that with the "&" symbol. He never saw or signed the contract so we were wondering if it is even valid? Even with a check in both names, if it is listed as "and" both people have to sign it for it to be deposited so does this rule carry to the contract world?

Help is much appreciated.

It depends on all the circumstances, but I would be very surprised if, after obtaining and using this credit to your benefit, a court would not require you to pay it back even if both of you hadn't signed.
