I have a real issue....The father of my son in a non US citizen nor is he a resident, he has a B1/B2 visitor's visa and comes back and forth as he feels, usually he cannot stay for more than 30 days at a time. He owns a town home here with his mother and a piece of land. He has no social security number or bank account. My child is a US citizen and is 3 years old and he has not supported him. His name is not on the birth certificate and he does not have his last name. He recently filed with the court an order for a paternity test and also visitation rights. the court granted his request for a paternity test. I am now married to US citizen who supports my child 100% and considers him his own. My question is once paternity is established will the courts here be able to have ANY jurisdiction over the US visitor ie child support enforcement/regular visitations. I seriously believe that he could be a flight risk and would kidnap my child. Any advice, how can I terminate his paternal rights once it is proven he is the father???

Nothing in your post suggests any reason to involuntarily terminate his rights once they are established. He will probably get visitation, and since he was never legally the father, he was under no legal obligation to support the child.

You should consult an attorney.
