Intermittent FMLA frequency and duration

    I am on intermittent FMLA and I have been approved for a per month frequency of 1 or 2 times with a duration of 1 or 2 days. I work 10 hour days Monday, Tuesday, Thursday, Friday. Days off are Wednesday, Saturday, Sunday. A total of 40 hours per week. On Tuesday I called in to advise I was going to be using an FMLA day. On Thursday I again called to advise I was going to use and FMLA day. My employer has advised me that this counts as my two occurrences for the month even though the company sick policy would consider it a single occurrence. I have been unable to locate anything in the Act that stipulates whether or not this is correct. Any thoughts?

    You did in fact report 2 occurrences. That is consistent with company policy. Your only recourse would be if that was not applied equally.
