Hi everyone;
The facts are that in Feb 2006, My wife was pulling into intersection from 4 way stop. She was hit at right front by stolen vehicle being chased by police, approx 40 mph. It spin here around instantly and even caused the right rear to be dented because of split second spin. She blacked out momentarily. She hates doctors, and didn't go to hospital. She had sore neck and headaches, and sought treatment from primary physician, who referred her for mri. Tests said she had 3 bulging disks in neck. Car totaled. I settled with ins co. on car after fighting over value, they eventually gave me amount I demanded. They called weekly to ck on wife's condition. She couldn't go to work for 7 months, but finally decided to try it. Since there was only 5k in medical she would'nt go to doc anymore. They offered her 10,00 settlement and we said no way. We hired atty. and he partnered with large firm that he worked with. Hope this is not too much info. Plaintiff who had stolen car was sent to prison (guns blazing during chase by police), therfore no insurance from other car. Attys filed suit against our insurance co, ininsured motorist claim. Including all their calculations, lost work, future med, pain & suffer, loss of corsortium, in all they asked for 125,000. case set for trial next march. Atty insisted she go to doctor and have more tests, with specialist. They determined she had 3 ruptured disks in neck. She had unusual personality changes and horrible depression, Atty made her see Psychoneurologist and he did many hours of testing. His conclusion was that she had suffered traumatic closed head brain injury to left rear of head. Thus he said in his report that she would have difficulties and that her personality changes are attributed to injury. She used to love being around people and was a total people person. Now she won't even go to grocery store, it causes her anxiety attacks. Doc told me that was a symptom of her injury. Further that she would have this forever. His words to me;she is no longer the same woman I married. She will be the one I am always married to. Been married 38 years. She is 56 I am 58. My question, finally. With this new information, shouldn't attorney ask for new amounts in settlement demand? This info has just been given to opposing counsel in discovery. I don't want to appear greedy but Our lives have been forever changed. I must say in general I don't trust atty's to do what is best for her. Please if you have info or opinion I would greatly appreciate it.
Thank You for any input, BLEEH
