If I have been overpaid, must I pay it back?

I have recently discovered that I might have been overpaid for as long as 1 1/2 yrs. My hourly wages are subject to a differential that I now think was figured incorrectly. I never paid much attention as it was deposited automatically. I want to tell my employer about the error so that I can be paid appropriately, but I cannot pay back the amount in question. Should I hire a local lawyer? Should I approach my employer and attempt to negotiate?

You should approach the employer to confirm if you really have been overpaid. If that is really the case, then you should tell them that you are willing to reimburse the company but you can only do it in installments. Hope this helps!

The longer you wait, the more you will have to repay. It is by no means impossible that your employer will either forgive the amount, or allow you to make installments, but if you really are being overpaid, they will find the mistake eventually and come after you. Better that you go to them.
