I have sole custody of my 6 year old daughter. Her biologicial father has visitation rights but really doesn't want anything to with her. He has only seen her 5 times in the last 6 years. I have been with a man since she was 2 months old so she calls him daddy. She knows of her father, but doesn't know him. If I were to die and left a noterized paper stating I wanted my custody to go to the only man she knows as daddy(we also have two other daughters together)because her father is a homeless drug addict would that be able to happen? How would I go about making sure that he does not get custody, because he can not take care of his self let alone my child. Please help me!
 
There is nothing you can do to make sure he does not get custody. You cannot will children. You can look into having your husband adopt and your ex's rights terminated. Your wishes may be looked at but Dad does have rights.
