I want to apply for child support, but my daugter's dad is an illegal immegrant from Mexico. I haven't applied becsause he told me he would ask for visitation. How does this work? I want her to see him, but only if it's supervised by the courts or myself. He is a flight risk, I can prove that he has numerous DUIs, was in hospital last Dec. with alcohol blood level 5 times legal limit. What I can't prove-he hit me in front of our daughter(why we broke up), caught him and his brother(also had at least one DUI) once each driving with her not in a car seat, told me he was selling coke. He doesn't have a driver's liscense or insurance. I just wanted to know how much do I have to prove to get supervised rights or do you think a judge would give him visitation? Since he's illegal, can I even get child support out of him? I live in Butler County, Ohio. Thanks for your help.
 
He can get visitation regardless of whether he pays child support.

If you think he is dangerous, then you need to tell the court.
 
Quite honestly, if paternity has not been established, I would not bother. He will likely get some sort of visitation plus if he is an illegal immigrant you have no way to get the money from him. As long as paternity has not been established he has no rights. Next time be a little more selective on who you have kids with.
