I need help! she won't let me see my kids! plus i'm unemployed and she still INSIST

I got fired. and the woman INSISTS I still pay $400 a month even though I'm on unemployment and is threatening to never let me see my kids until I pay the $400 a month again. I'm crushed over not seeing my two kids and I have no money to pay an attorney. my kids are 11 and 9 years old and they love me. i love them. we HAD spent good times together.

To make it convenient to me, I had written her some post dated checks before I was fired. She was to cash each one on the first of the month that was on the check. When I started sending her 22.5% of my unemployment earnings rather than the $400 a month, she said FORGET our agreement, she started cashing the checks early, which caused me bounce fees and my account to go so far in the negative that I had to cancel the account and now I can't pay bills.

I need legal help. I CAN prove I've been paying and never miss a month. I just need to get a judge to force unsupervised visitation so I can take my kids with me to places when I visist IL and I want to get my kids for a couple of months each summer just like I HAD been doing.

You can do 1 of 2 things. You can contact your local legal aid office to see if you qualify for help.

Or you can go down to the courts and file contempt charges yourself. Cs and visitation are 2 seperate things, she is not supposed to be withholding visits just because you are behind on your CS. I am assuming you have a set in stone visitation schedule? If so, go down to the family court and file contempt charges. There might even be a family court facilitator that can point you in the right direction. All courts have a self help/law library where you can pick up the forms you need. I would do that. It might not hurt to call around to a fathers rights attorney and see if they can help you pro bono but that is doubtful. You probably will have more luck in filing on your own.

Document her demands for money to see the kids. A judge might not be too impressed with her.
