I am a distributee of my grandmother's estate in New York. My grandmother died without a will and my uncle was appointed the Administrator for her estate. An accounting for the estate has been filed with the Surrogate Court and her final credit card bills seem excessive. My uncle refuses to provide credit card statements that would prove if any purchases were made after my grandmother's death and I have reason to believe that he made used her credit cards after her death. The credit card companies will not release any information to me. I have been advised to compel my uncle to release the credit card statements through a subpoena of discovery. Can anyone direct me to an example of this legal document?
