I believe I am being treated poorly

Good day to all. I have been working in the same facility for more than a year. It is a solar manufacturing facility.

I believe I am being treated poorly by this particular Supervisor. Last week I went to the dentist to get a mollar out. Therefore i was advised by the doctor not to be around heat etc. during my healing process so they moved me to a different department. During the first 2 days my supervisor was coming over to check on me and at the same time she asked me if I liked it there and I said yes and she asked me if I wanted to stay there and I say I don't mind. And I told her that if I was needed back to where I was I will definitely support them if they are short staffed. So everyone was happy I guess but yesterday everything changed because half of the crew called off. And she asked my shift lead if I can go back to my old spot which is welding, and my shift lead said "well I'm also short staffed here today in the testing room" so now this supervisor has blocked me to do any overtime even on different shifts which I been doing so for months!… me and that supervisor had a conversation about it and she simply said because I moved out of welding that I don't get to do overtime unless is the testing room. But there is others that are doing overtime for different departments so I think she is taking this on a personal level and being petty. So I disagree with her totally and I asked her for her boss email via text and she never replied to me.

By the way last year I made around $20k in just overtime. And since that supervisor knows that I was the most valuable person as welder and now that she is short staffed in the welding department an my current shift lead won't let me go back to welding because she also needs me in the testing room the supervisor has blocked me now for any overtime even on different shifts…. For any positions. (In the past I have worked in several departments that how I was able to put $20k plus in just overtime because of my various skills and I like to support the company as much as I can).

Should I write a complaint to HR instead of going to her manager? I have documented all conversations and saved all text communications with that particular supervisor.


PS- That supervisor is trying to hurt my income because she is not blocking others for overtime is just me.

Perhaps you are being treated poorly, either intentionally or simply because they are are trying to do the best they can do to keep production up with all the short staffing. However being treated poorly or not getting the overtime others are getting is not by itself illegal. The big question is why are they blocking you from going back to welding or to that other job that offers the overtime.

It is illegal under federal law if the reason is because of your race, color, national origin, religion, age (if you are at least age 60), sex or gender identity, national origin, genetic testing information, or disability (assuming you can do the job despite the disability).

Under Arizona it's illegal if the real reason is your race, color, religion, sex (including pregnancy and sexual orientation), national origin, age (40+), genetics, or disability.

You can get more information on employment discrimination under federal law from the U.S. Equal Opportunity Commission (EEOC). Also look at information on Arizona employment discrimination law.

If after reading that you think you may have been illegally discriminated against by your employer, talk to a lawyer who handles employment discrimination claims to see if you have a strong case. Do it fairly quickly. You may have as little as 180 days from the date of the discriminatory action to file your complaint with the federal and state agencies that enforce these laws. If you miss that deadline then you'll be barred from filing a lawsuit to get compensation for harm from any discrimination you suffered.
