i am german - want to take son back to germany after divorce

i have been married to my husband for 4 yrs. i am german - he is american. we married here in minnesota. we have one son who is 3 yrs old.

my husband never really took care of our son when he was just born. when i asked him to get up with him during the night he would yell at me and slam doors and then yell at our son. he told dead baby jokes when i was pregnant. he yelled at me almost every night for months when i didnt want to give him sex after our son was born. he punched a whole in our sons door. the only thing he does is go to work, watch tv or computer and instead of teaching our son how to behave he yells at him from the couch. he told me to f... off in front of him and to go back to germany. the list is endless. he is not a good rolemodel for our son and i dont want my son to grow up with an abusive father.

i have been thinking about getting a divorce for a looong time now and moving back to germany with my son. now my question: what are my chances of me taking my son home to germany with me. he has dual citizenship. i seriously dont want to get stuck here....

some help is greatly appreciated!

Your son is American though and so is his dad so you will have a very hard time taking the child out of the country without dads permission. Dad could be granted custody of the child if the courts feel the child is better off with Dad. All of what you say has no bearing on whether you will be allowed to move the child out of the country. Dad cannot be that bad if you have stayed with him this long.

See an attorney.
