husband in jail can i get a divorce

My husband and I have been seperated fornearly 4 yrs and the divorce has been postponed by him several times (never postponed by me). I am using legal aid attorney. My husband has been put in jail on 12 charges of child sodomy and child rape. Our divorce is now scheduled for 4/6/06. I know he won't be out of jail before then. My question is will I be able to finally procede with the divorce and will he be able to get visitations of our 4 children? He is in jail across the street from court house.

I would think that he forfieted all his rights by being in jail. what's the problem? all you have to do is have him served. they know where to find him LOL. I SERIOULY doubt that he will even be allowed anywhere near a child for the rest of his life.
