how much legal rights do grand parents have to grand chilren

i just resently found out that my mother has congestive heart failure. i am now concerned about my brothers who are 11 and 12 years old. at a young age their father had signed over his paarental rights to my mother. i am now worried about if something happenes to my mother were would my brothers go. their grand mother has been an active part of their life and as far as i know she would want them to stay with her. but her son had signed over his parental rights. so my question is how much of a legal leg does she have to stand on if something happeneds to my mother. as far as i can tell i would be next of kin to my brothers i am 21 years old and am more than capable to care for them. i need to know what needs to be done to insure that i would get them.

First off, congestive heart failure is not a death sentence, your mom could and probably will live for a long time, depending on the severity of her condition. Ask her what her doctor says and support any lifestyle changes she may need to make.

How often do the boys see you vs their paternal grandmother? Do you have a home with an extra bedroom? A stable job? Do you live nearby? Does Grandma?

It is doubtful your dad legally signed over his parental rights if nobody adopted them but you'll have to see what the court paperwork says. I agree that congestive heart failure can take years.

If your mother does pass then you could ask the courts for custody. If Dad has done nothing then it would be unlikely he would get custody. If your mom passes before the kids are 18 then you need to apply for SS survivors benefits.

my mother just found out about it about 2 weeks ago and she also found out it has been like this for the past 12 years and only gotten worse

not my father their father... he did sign over his rights he had done that to get out of child support and has not seen his sons since then
