Hello. My ex fiance and I purchased a condo togethr and we have been seperated for nearly 3 years now. She has not made any effort to refinance the home to remove me off the mortgage. I don't want to have anymore responsibility for the house, since I haven't lived there in so long. Unfortunately, I do STILL have belongings in the house I haven't been able to recover. I was told I could have a key made and have the officer accompany me to retreive my things... How true is this? I also want to know what steps I can take to have her refinance the house in a more timely manner? What rights do I have as far as this property is concerned? She's completely acting out of spite and I want this resolved!! Please HELP!!
 
As long as your name is on the note, you will be held responsible.

You must take affirmative steps to have your name taken off the note though court process.

That can be difficult, but is worth it.

I wouldn't worry about the stuff, as you've lived without it for this long.

Having a key made, might be problematic for you.

As you no longer reside in the residence, an argument can be made that you have no legal standing to possess a key.

Asking the court for relief in obtaining your stuff, is a much better curative.

As I recall, TN uses Chancery Couts for matters such as these.

I'd speak with a lawyer about these issues ASAP.

You are at great risk financially and in several other ways.

Get this encumbrance off your back before it explodes.
