Holiday Pay

My husband's work handbook states "All employees scheduled to work the following holidays will receive time and a half for that day's pay" Then continues to list holidays in which it includes Labor Day. Ok, now here is the situation, he works different shifts. He was scheduled to work Sunday, September 2 on graveyard and clocked in at 11:00pm and clocked out on Monday, September 3, at 7:00am. (Labor Day). So he physically worked seven hours on Monday. On the written schedule it shows written Sunday 11-7, Monday, off (which is his normal). The question is, is he entitled to get the holiday pay for the seven hours he worked on that day? He was told he does not get holiday pay, since he clocked in on Sunday.

That is going to depend entirely on company policy and how they define the holiday. The law does not require that he receive holiday pay at all.
