    i had neck surgery i used all my sick days plus when on short term disability with my FMLA i tried to return back to work and they told me there not hiring is this legal its a non union job as a school bus driving plus i lost all my insurance benifits

    How long exactly were you out? It makes a difference.

    Did you use up all your job protected FMLA leave (12 weeks) before you tried to return to work?

    It is really unclear what happened here. Were you let go because they had a reduction in force? Are you union? How long were you out? Did you actually fall under FMLA (many drivers do not)?
