I have been raising my step children for the past seven years. There is a order of joint custody with residency with there father(myself).There biological mother has stop visitations in March and stop contacting by phone in April. How long is til its considered abbondonment? Will this be enough to go for sole custody?The children are 9 and 10 and are very upset.

Dad can certainly ask for sole. It will not stop mom though from having visitation with the kids. She is still Mom. Does she pay child support?

She has been paying because it comes auto out of pay check. Its the only way we know she is alive just counting the days til it stops.

As long as she is paying child support, there is no abandonment.
