My daughter is 5 years old. Her father walked out on me when I told him I was pregnant. He has never seen her nor has he paid me one penny!! His name is not on her birth certificate. My husband now wants to adopt her. I have been with him since I was 4 months pregnant and as far as I am concerned, he is her father. Can he adopt her without her biological father's consent??

No. Your bigger problem is that you have no Father to give up rights

I would check with an attorney about that. Since her father's name isn't on the birth certificate then I would say your husband should be able to with no problem.

Its likely they will request you make an effort to find Father before adoption can take place. I agree find an Attorney however its not up to you alone to decide that Father has no rights. I agree hes a heal but he still has rights. Do you know how to contact Father? Judge might ask who Father is and why his name is not on BC?
