I have a 3 year old son. I have paterniry established with his father and child support is garnished automatically from his paycheck. when this all was set up there was no visitation set up what so ever! I have full custody of my son.
I am married have been with my husband since October got married in December. My husband and I have always had a good relationship prior to dating and marriage, and he wants to adopt my son. ( we have known each other for 6 years and dated prior to October.)
I want to know the process to which I am going to encounter. My sons "father" hasn't seen him since October. He says he cant come to visit him because he is in the military. (which my husband is too and still sees both of us monthly.) He has seen my son 5 times maybe in his 3 years. He doesnt call but his mother does. She keeps telling me she is going to take me to court for grandparent rights. I was curious to know, how can she do this if she sees him monthly?
She also wants to take my son 800 miles away for a week. I am denying her this right for the simple fact my son was just diagnosed Tuesday with Scarlet Fever. Since there is no visitation set up do I have to worry about ?
Grandmother lives in Kentucky I live in Indiana.
Father lives in Georgia.
Any help or advice would be great!!!
