Medical Malpractice Hear Say Could Have Killed Me!

I have been taking several pain medications for severe pain for more than 10years. This list includes Oxycontin, Valium, Methadone, Percocet, Nuerontin and Cymbalta. I also take high blood pressure, siezure, migraine, fibro myalgia and restless leg syndrome medications. I was seeing a pain specialist for severe chronic pain due to degenerative disc disease, 2 hemangiomas in my L1 L2 vertebral bodies, several bulging discs, 3 ruptured discs, cauda equina syndrome, spurs in my spine pressing on my spinal cord, severe spinal stenosis from lumbar to saccral region, spinal cord encroachment, nerve damage to both legs from the stenosis, numbness and heaviness in both legs with RLS, fibro myalgia, manic depression, anxiety disorder, panic disorder and epilepsy. I'm sure I might have missed something but you get the idea. I had a neighbor try to take my medications from me and I wouldn't give them any. There was a big argument and I threatened to call the police. Then the neighbors said if you don't give us your medicine we'll make sure you don't get avy more. The next day was my appointment with my Dr. He wouldn't se me until I paid the $100.00 visit fee. That was unusual because I always paid it on my way out. When he called me into his room he said, and I quote "somebody called yesterday and left a message saying that you are selling your medications" I immediately thought about what my neighbors said and I explained what had happened and asked him if he had a name of the caller. I told him I bet I can tell you who called because of the altercation the day before. He said it was on his answering machine, did't know if it was man or woman but he would no longer see me or prescribe my medications. I ASKED HIM TO DO A DRUG SCREEN TO PROVE THAT I TAKE MY MEDICATIONS. I DO NOT SELL THEM!!! He would not even discuss the situation. He took comlete hear say and walked me to the door and kept my $100.00. As soon as I got outside of the building I called my primary care physician and mad an appointment for the very next morning. I told her what had happened, she was skeptical but she stepped up to help me by giving me a drug screen so I could prove that I take my medications because I have no quality of life with out them. A few days later the drug screen came in and without a doubt proved that I take my medicines. I thank god she took the time to do that drug screen, she is a wonderful doctor that really cares about her patients. All that said, I COULD HAVE HAD A HEART ATTACK, STROKE, OR MAYBE EVEN WORSE BY STOPPING THOSE TYPES OF MEDICATIONS ABRUPTLY. I JUST WANT TO KNOW ISN'T THERE A LAW AGAINST USING HEAR SAY TO CAUSE SOMEONE SEIOUS HARM, DOESN'T A DOCTOR SUPPOSED TO HAVE SOME TYPE OF RESPONSABILITY TO HIS PATIENT TO ATLEAST USE SOME KIND OF PROTOCOL IN A SITUATION LIKE THIS OR CAN JUST ANYBODY RUIN YOUR LIFE BECAUSE YOU DIDN'T GIVE THEM WHAT THEY WANT AND OUR DOCTORS THAT WE ARE SUPPOSED TO TRUST WITH OUR LIVES LISTEN TO AN ANONOMYS CALLER AND PUT OUR LIFE AT RISK. I need to know if this could be a malpractice issue, if so do you think I have a case? I WOULD TOTALLY APPRECIATE AN INTELLEGENT AND STRAIT FORWAD ANSWER! THANK YOU, LISA
 
No, this is not a malpractice issue. You cannot sue for what might have happened.
 
A doctor has the right to refuse to prescribe you medications when such allegations are made until the resolution of the said charge of illegal sales. Those are very serious charges which could cause the doctor's license if they continue renewing your prescription without a police investigation. So he did not want to spend time on this and just let you go look for another doctor. If someone died from an overdose of the medication sold illegally (for example traced to your medication), the doctor would be in big trouble for not informing relevant authorities and police of the allegation against you. The doctor here took the easy way out by washing his hands off. You have no case under such circumstances….. Sorry for your unfortunate incident.
