I haven't seen my son in five years due to father has moved around alot in the state he is living , however every yr or or so he finds a way to contact me. In our last conversation he stated he wanted his new wife to adopt our son. Meanwhile i have been ordered to pay child support 222 a month and back child support of 5000. I would just like to know how i could even going about starting the process my self of giving up my rights? I'm on welfare and not working due to arised medical issue and taking care of 3 yr old living with me at home. Please some advise.

If your husband want s his wife to adopt your son and you are willing, his lawyer should have the paperwork for you fill out. Are you able to sit down with their lawyer? If he hasn't gotten a lawyer yet, let him know you are willing and that when he gets a lawyer you would like to meet.

I would do that but he hasnt even started the process. So how could i go about starting the process my self its been 6 months since he told me he was going do this.

I am not sure...but it would seem that he would have to start the process as his wife needs to adopt. If that part is not in place (the adoption) then you cannot give up your rights. You can hire your own lawyer, but according to you, you may not be able to afford this. You can google your state law on adoption of a step-child and may find something helpful there.
