Harrassment on my job

today on my job 06/29/2005 at 3:30pm central time A man called me only id his self by first and last name.This man ask for me by my full name.He said he was calling to give me a message from the payday loan company. That if I didnt pay my payday loan before July 01,2005 that I would be arrested for fraud and so on.He started harrassing me by saying I never had intentions to pay this loan and so on and I work in a call center and all the calls are recorded.This man never state the mini miranda.This man tried to act as if he was with a law enforcement.And no he didnt Id his self as a law enforcement.I told him to never call my job again and please call me on my mobile.As soon as I hung my job phone he was calling my mobile and with more insults he begin saying that the sheriff office will pick me up from my job and he said my social# was my case #.And then the call ended after he said all he had to say.Right after he got off my cell phone my desk phone was ringing again and it was him for the second time after I told him not to call my job. He wanted to get my job address and I gave it to him.Yet and still out of these 3 calls he never inform me he was a debt collector.After he hung up.I called the number back that showed on the caller id and it was a collection company here in Texas.I spoke with a man name David who said he was a manger and also in charge of the company.I begin telling him what happen and that the calls were recorded and at first he tried to get rude he ask me what did I wanna see happen.Then he ask me if he could hear the calls and I told not at the present.I would have to check with QA.He asked me how could he fix it I told him if this had happen on my cell phone then I would be more at ease.But this man called me on my job line this means that Qa dept and my supervisors heard this call also.So after I explain everything David told me he would speak to the owner and get his collector side of the story and he did this.David told me he would call me back and he did around 5:30pm and he apologize and said his company had been in business for 12 years and that they didnt want a lawsuit or anything .He said he would wipe my payday loan clean .He said the owner had already approve this and the owner would deal with the collector.Im now thniking I guess this is good what more can I ask for.But when I got off of work and got home my husband said that the same man had called my home and said im due in court on July 01,2005.So I had to tell my story all over again to my husband who thought this was wrong.My payday loan was only $280.00..So why was I harrassed on my job phone and embrassed.And I told David yes I accept them wiping this loan clean and Im satisfied with this decision but he did promise to send me something in the mail showing this he just said if I had anymore problems contact him.he gave me his first and last name.And I did agree to his terms and he must have been recording the call without my permission. I cant help when his collector called my business phone at work the calls are recorded.After i spoke to that collector my nerves got very bad, I had to get off my phone and go to the break room.My head pounded.it is a shame that collections firms can get away with this.I really would like to sue this company and teach them to train better people to follow State law that was enforce long before this company open.

what should I do?

The debt collector's actions are not unusual unfortunately although they are unlawful. I believe the collector should be registered with the state and you should be able to file a complaint there as well. However, this might a case of a rogue employee going too far (then again, this might be good cop bad cop.) I don't disagree with how you feel. Perhaps you can find out later what happened with the employee and make a decision about what to do. While I do recall remedies available under law against this harassment, I'm not sure that this will be of more assistance. Likely some of these remedies never make their way into use unless there is rampant abuse from a specific collector unfortunately. As the collections company may have purchased the debt, you might be able to reduce the damages or tell them you'll show up in court and request the judge reduce the damages and counterclaim after they hear the outrageous and unlawful conduct that occurred. In most cases you can make this worthwhile by reducing the amount and obtaining complete clearance of a debt.
