My son , daughter-in-law and 9 mo. old grandson moved to oregon from Georgia to live with us due to the economy about 4 weeks ago My daughter-in-law has threatened to leave and take the baby back to Ga. Can she do that ?
 
Sure she could. So could he.

If they wanted to divorce, your son could file for custody or visitation. Because they've only been in Oregon for a few weeks, she won't be required to return, but your son would be free to follow her back to Georgia.

If they do divorce, terms could be written into the parenting plan requiring notice of intention to move and the other parent can object in court if necessary.
 
I read up on oregon law and it states that you have to be a resident for 6mo. before you can file for divorce ?? is this correct
 
Yes she would have to live in a state for usually 6 months before she files. So if she leaves, her husband would file where he lives for divorce and custody, assuming he has been in his current state for 6 months. He doesn't have to let her leave but I do not know how he can stop her. She needs to realize though she will irritate a court and could be told to move back.
