My boyfriend is twenty five years old has a steady job and currently has full custody of his two sons from a previous marriage. Some time after him and his ex wife split my boyfriend was in a relationship in which they had an unplanned baby girl. The relationship ended six months ago and the little girl is just about a year old. The mother says she does not want to take my boyfriend to court and says that she is fine with the arrangements they have currently. While my boyfriend works she has the little girl and on the days she has night school my boyfriend has her. This seems to be working just fine. My boyfriend already gets her at least 3 to 4 days a week. The mother is thinking of joining the air force, her parents want her to give custody to them and are working to push my boyfriend out of the picture as well. They came to him saying they are going to fight for full custody and maybe let him see her on weekends. Do they have this right? The mother is unaware that her parents are going behind her back to take full custody from both her and my boyfriend. How can they do this when both of the parents want custody, are not abusing the child, and are financially stable?

They really can't. Tell your boyfriend to tell his ex what has transpired and that a formal custody and support order needs to be done ASAP. Joint legal and Joint Physical custody shouldn't appropriate considering the good co-parenting relationship they enjoy.

Your boyfriend needs to stop listening to them BUT he needs to file for custody and start talking to mom. Grandparents have no rights to custody over either parent. Mom has no authority either to give her parents custody. Has paternity even been established? Did he sign the birth paperwork? If mom is going to join the military it is important dad get paternity established if it has not been. and he secure custody.
