Golf Investors have demanded Capitol Fund from Members. Will Terminate Our membership if not Paid

I have attached the Membership pages that discuss the Fee's, Dues and Charges. I do not see a clause that we have agreed to pay this new capitol Assessment. In addition the Investors have demanded a monthly Capitol Fee be charged in addition to our Dues.

I do not see where it states we are a private or semi private club either. The ownership allows their hotel guests to play as well as outside tournaments. There is nothing but an email making line item statements on what the membership will pay these new dues for. Several of the line items have nothing to do with golf.

Can they legally terminate our membership if we do not pay?

Thank you for taking the time to look at this.

I read it (quickly). Paragraph 1 of the document seems to sink the OP.
Thank you. I did not know if "supplement" or any of the language that states they have the right to change the "plan, rules or regulations" could be a way to charge us this new capitol Assessment Never discussed with any member till last week.

You posted this phrase on the other site:

"supplement, change the rules & regulations and the plan".

Which is what they are doing and giving you notice.

You are not legally obligated to pay into the fund. They are not legally obligated to continue your membership.

That phrase you quoted gives them the right.

It's like when you get the letter from your credit card company changing the terms, raising the interest, etc, and you are given notice that you can accept the changes or, if you don't, you don't get to use the card anymore.

Thank you for your insight. This email message gave us two weeks to decide if we're going to pay it. They will raise well over a million dollars if everyone pays. Non golf related items like building hotel rooms, shuttling guests to the airport, building tennis courts are a part of what they said they would use the money for and there is no paperwork/financials to back any of this up. Just the email and two weeks notice. This course was recently purchased and re designed. Opened in May 2023 with a large initiation fee.

If you think about the issue, you'll likely conclude LEAVING THE CLUB, GANG, GROUP, BUNCH heals you, while HARMING, the evil, vile, greedy, useless hostel posing as a HOTEL..

ONLY SPEND YOUR MOOLA where your custom is appreciated and celebrated. Berating and ignoring a customer, causes only the peddler trying to surreptitiously Slick unsuspecting suckers out of his, her, it's loot!!!!

Now might be the time to say, no thanks, I've decided to retain my money, custom, and dignity.

Concur. "The Club reserves the right, in its discretion, to terminate, amend, modify or supplement this Agreement, the Plan and the Rules & Regulations, . . . [and] to recall any Membership at any time for any or no reason whatsoever, . . . and to make any other changes in the terms and conditions of Membership. . . ."

In other words, "we can change or charge anything at any time and terminate any membership for any reason" (the "no reason" language is nonsense since nothing has ever happened for no reason).

(the "no reason" language is nonsense since nothing has ever happened for no reason).
I bet somebody was trying to avoid getting into the "for cause" language. But, yes, "any reason" encompasses "no reason" and is redundant.

MY Dad often said, "If the bunch is getting cheated, that's the time to become a" BUNCH QUITTER".

A grieving young Irish immigrant puts his motherless infant son in the hands of strangers and sails away, never to be heard from again. An old cowboy turns his ranch over to his wife and rides off into the sunset. A glimpse of a hobo waiting by muddy waters to board a west-bound freight train, the stuff of a young boy's dreams.

I went out on the road in pursuit of angels and some crazed notion of perfect freedom, after I returned from Vietnam. I disappeared for ten years into the drama that was America in the sixties and seventies. Among other things, I learned that visions are not confined to saints and schizophrenics, I could be violently seasick for a week and survive, and not everyone wants rescue. Unable to sustain the degree of rootlessness and isolation that I found out on the road and yet unable to see a place in society to rest my head, I let the road become my prison.

*bunch quitter: a colloquial expression generally used to describe an animal, usually a cow or steer, that resists being herded or controlled. This resistance can sometimes take the form of violent and even self-destructive behavior.
