Golf Investors have demanded Capitol Fund from Members. Will Terminate Our membership if not Paid

I have attached the Membership pages that discuss the Fee's, Dues and Charges. I do not see a clause that we have agreed to pay this new capitol Assessment. In addition the Investors have demanded a monthly Capitol Fee be charged in addition to our Dues.

I do not see where it states we are a private or semi private club either. The ownership allows their hotel guests to play as well as outside tournaments. There is nothing but an email making line item statements on what the membership will pay these new dues for. Several of the line items have nothing to do with golf.

Can they legally terminate our membership if we do not pay?

Thank you for taking the time to look at this.

I read it (quickly). Paragraph 1 of the document seems to sink the OP.
Thank you. I did not know if "supplement" or any of the language that states they have the right to change the "plan, rules or regulations" could be a way to charge us this new capitol Assessment Never discussed with any member till last week.

You posted this phrase on the other site:

"supplement, change the rules & regulations and the plan".

Which is what they are doing and giving you notice.

You are not legally obligated to pay into the fund. They are not legally obligated to continue your membership.

That phrase you quoted gives them the right.

It's like when you get the letter from your credit card company changing the terms, raising the interest, etc, and you are given notice that you can accept the changes or, if you don't, you don't get to use the card anymore.

Thank you for your insight. This email message gave us two weeks to decide if we're going to pay it. They will raise well over a million dollars if everyone pays. Non golf related items like building hotel rooms, shuttling guests to the airport, building tennis courts are a part of what they said they would use the money for and there is no paperwork/financials to back any of this up. Just the email and two weeks notice. This course was recently purchased and re designed. Opened in May 2023 with a large initiation fee.
