I have a 3 yr old son. His mother and I have lived together for 4 yrs and I am listed on the birth certificate as the father. We have done parternity test, I am the father. However, is their more I need to do to insure mine as well as his rights to each other? His Mom and I have a roll a coaster relationship and often when we are upset she treatens to go and not let me see our son. Can this happen? If I were to pass away would he be entitled to my assets? I do have a will that names him but is that enough? His mom claims that if she were to pass he would go to the state and not me because we are not married. That sounds ridiculous and probably just pressure for me to marry but I want to be sure.

Did you sign the Affadavit of Paternity when your son was born? I'm not sure if that's a requirement before naming the father on the birth certificate in Georgia. If you did sign it, then you have the same rights as the mother; however, if you two break up, you will have to file a petition for visitation/custody with the court. If you did not sign the AOP, then you can (and should) do so now.

I believe he has legitimize his son in GA. I'm not sure how it's done, but the local courthouse should be able to help.

It sounds like you are the boys legal father. Stop listening to mom. If something happens to mom then you would get custody. You should file for visitation in court so mom cannot play any more games with you. stop doing things her way.
