Hello, i recently was arrested and given a ticket for furnishing alcohol to a minor. I was not sure what i should do, but was hoping for some advice. I worked in pizza delivery, and i am not a dependent any longer with the military. Sometimes i was asked to deliver alcohol, or cigerettes, or even mountain dew by customers. Sometimes i would deliver alcohol if they offered a 20 dollar tip, or something along those lines. I always made sure they were 21 or of age if it was cigerettes. The guy i got arrested for turned out to not be 21 though. I delivered to him a few months prior, and upon arrival had to verify his id and with his credit card. We had a conversation, (did not deliver alcohol on this delivery) upon which i explained how sometimes i delivered for a good tip. I delivered to him the next time, and i even called on my way and asked, "your 21 right". He told me he was, and when i arrived i can not remember if he showed me his id again or not. This continued a few more times. Then i recieved a call, asking me if i delivered to minors, i said i would not do something like that. They asked me to stop, upon which i said i will not deliver anything other then pizza regardless from now on, just to be safe. About a month or two later i was arrested for an investigation, they told me there was 4 witnesses against me, and asked for my sworn statement. Im not sure exactly what i should do, but i was barred, (kicked of indefinitely) from the base and fired from my job. I have not recieved a court date in the mail, and it has been two weeks. They told me it was a federal case, and i am not sure what i should do. the rcw was 66.44.270. They gave me a fed cite, thats it, but i have not recieved anything else, and am not sure if i should talk to a lawyer or what. any infomation would be helpful.

You absolutly need a lawyer for this. First of all, how do you verify age with a credit card? Anyone 18 or older can have a card, and cards can be faked rather easily at that. And if you think about it, what do you as the pizza guy do with the card? Rub the numbers into the receipt? That doesn't verify it's actually his card. Even if it's a good card, it doesn't verify age.

Secondly you aren't sure if you ever checked the guy's ID. Again, those can be faked, but regardless, if someone under age knows you will deliver for a good tip, what do you think he's going to say if you ask if he's 21 or more? You took a hell of a risk, and now it has caugth up with you. Get a lawyer.

Also, if you are delivering alcohol and you are not legally delivering it from your employer (and this probably is not legal), you are probably guilty of a number of additional offenses as well as providing to minors.

This offense is a gross misdemeanor and is punishable "by imprisonment in the county jail for a maximum term fixed by the court of not more than one year, or by a fine in an amount fixed by the court of not more than five thousand dollars, or by both such imprisonment and fine."

An attorney is advised.
