John Q was driving his motorcyce minding his business - Pickup Truck Billy was slowing down and speeding up and driving erratically - pickup truck Billy rear ends John Q on motorcycle - in a fit of rage John Q gets off his motorcycle and punches the person who hit him Pickup Billy. Cops show up and determine it is Pickup Billy's fault for accident but then issues a "Simple Battery" ticket to John Q. John Q has sustained injuries and went to the hospital and is now receiving treatment for his injuries. Will John Q's Simple Battery Ticket result in him losing in a court of Law for the rear end that was clearly Pickup Billys fault? Also Pickup Billy was 151/2 and driving with just an instruction permit - not sure as to who the passengers were but they appeared to be young. The age of Pickup Billy was not disclosed until after the punch and after the police offider provided the summons for simple battery. The police officer also issued a ticket that the fault was on Pickup Billy for rear ending the motorcycle.
