FMLA denied

My son had been in and out of the doctor with ring worm. Since this is so contagious I could not take him to daycare and was forced to take time off of work. I filled out my FMLA paperwork for this and they denied it saying this is not a "serious illness." Can they get away with this? How "serious" does it have to be? I could have taken him to the ER to have the day excused but why waste the doc's time and my money taking my son to the ER for that? There should be laws on that or specific guidelines that specify what exactly a "serious illness" is and what is actually covered by FMLA. Why have it if we can't use it?
 
There are laws that specify exactly what a serious illness is, and they are defined in the FMLA statute itself. Ringworm doesn't make it. Even if you'd taken him to the ER.
