A few months ago my ex filed for custody of our daughter. She moved her to another town within the state and we've been to court a few times. I have been granted visitation each Sunday from 1pm-7pm, with pickup and drop off of our daughter to be at the police stations in the towns we live in. There is a court order in place stating the pickup and drop off locations, as well as the time. For the sole purpose of documentation, I email my ex every week the day before the visit to say I will be at the pick up location. Last week I was notified by my ex at the last minute that my daughter would be "unavailable" for my visit. This week I received an email from my ex the morning of the visit saying that because I did not confirm with 24 hours notice there would be no visit. The pick up is at 1pm on Sunday, I emailed her at 1:04pm the day before (Saturday). I notified her that I would be at the pick up location at 1pm and do not need to confirm with 24 hours notice. I went to the police station in her town to pick up my daughter and they never showed up. At that point I went inside and filed an incident report with the police to document that I was there and she was not.
Last time I was in court I told the judge that she has been denying my visits for absolutely no reason and was informed that I need to file a motion for contempt against her. I can not afford a lawyer so I am representing myself. I'm trying to figure out how to file a motion for contempt before the next court date. Any information is much appreciated.
