federal tax deductions

Does anyone have advice? My divorce states my ex and I each claim a child for deduction for taxes...but it's really unfair as the IRS states that whomever provides 50% of childs well being should claim the children and I provided 90% of both children's well being. He's not spent more than 6 hours with both girls in the last 16 months. Any advice how to get this changed? The county courts said no...as divorce decree gives him a deduction but this is a federal issue not a county issue?

a court order overrides what the IRS says. If Dad pays CS then I think you each claiming one is fair. You will have a really hard time taking the deduction away from Dad. You'll hve to go to court.
 
I feel like you better consult a legal adviser about tax deductions.

Bad advice because the court order gives dad the tax credit. Court orders take precedence here. My husband just went through this. The IRS is going to ask for the divorce decree on who gets to claim. My husband had to fax it in and they saw he was entitled to claim the child so they gave him the credit despite what mom wanted.
