Excluding Biological Father

I'm concerned for a family member. He is involved with a woman who is pregnant with another man's child. They are trying to exclude the father from the girlfriend's and the child's lives. My family member wants to put his name on the birth certificate so the father cannot gain custody later. What should I tell him? Can the father still try to get custody later? What legal actions should he and his girlfriend take to keep the father away from them?

Well besides paternity fraud, there is nothing they can do to keep the bio Dad from going to court and disputing paternity. He likely will be granted a paternity test as long as it is done within the allowed amount of time. The bio Dad would need to take ation on this. If he does nothing then the non bio dad and the woman may get away with this.

If the woman wants this guy totally out of the picture, she should not have gotten pregnant by him.

You might want to consider changing your signature quote, since you are advising me to do the exact opposite of what your quote states: "Be not niggardly of ... counsel ..."

You want legal advice? Its not you who requires the advice as SJ stated. However placing a name other than the "known" Father's name on BC is fraud and a crime. You want legal advice to pass on then tell him not to do this! this woman made a choice to sleep with this man and a child is the result. She is now forever tied to this man. She or anyone does not get to decide if he gets to be Dad or not.:no:
