My EX wife and got back together a couple of years ago(didnt get remarried). I bought a house (mortgage in my name only) But we signed a right of survivorship deed so she would get the house if I died. Now we want to split up, but she doesnt want to move out , she wants me to move out. She cannot get a mortgage( bad credit). I want the house. There is no equity in the house. Can i get a motion to have her move out and sign a quit claim deed? Do I need an attorney or can i file at the courthouse for a hearing. And what are my chances/options? We live in NC ,

Yes you will have to ask for exclusive possestion of the house and have her evicted. She though technically owns the house too since you put her on the deed. You should not have put her on the deed if you did not remarry her. You need an attorney. You can use the ground that she will not be able to refi the house into her name only and with no equity a refi is probably not possible anyways.
