Our Summer schedule of week on week off has began, and our daughters (5 & 7) spoke with their mother Saturday morning. They told her what our plans were that day, (Go up and visit my fiance's family). It wasn't until we returned later that evening, that The owner of the house we rent, was approached by my ex who drove all the way out to our house to talk with her about our custody arrangement. She was trying to get information on what the living arrangements were etc... The owner refused to talk to her about anything and asked her to leave. We are in the middle of a huge custody battle right now, where as I am asking the courts to change custody based on her mental capacity and poor decisions in regards to our daughters well being, we currently have joint, but with her having full Physical. She was ordered by the courts to submit to a psyche evaluation, within 7 days of teh order and she hasn't. SO according to the psycholgist she is in contempt of court. With her coming out unannounced and invited strictly to try and gain some sort of leverage, what should I do next. We are both going at this Pro per. Should I notify the psychologist so that she may put this in her evaluation? Any imput would be appreciated.

Only a judge, the judge sitting on your case, can rule the either of you are in contempt.

You can inform the pyschologist of what you've learned.

I don't think it will have any bearing on your case, but you're free to tell the shrink and eventually, the judge.

You might want to make adjustments to your living arrangements, especially when your children arrive.

These days, courts don't take as much notice of that as they did 40-50 years ago.

I'd wonder why my "ex" was so curious and surreptitiously attempting to gather specific information about MY living arrangements.

I'd also consider retaining an attorney, especially since the other party is operating "pro se".

It would provide me with greater leverage over the other party!
