Ex no longer paying child support

I have a question, my ex b/f and I broke up when our son was 1, he is 6 now and he has been giving me chump change to support our child, I never seeked court ordered child support to avoid having to see his face or deal with him (he rarely sees our son) well for the past 5 weeks I have not seen one dime, I hear he is not working (but regardless, when he does work he makes money cash under the table, in his words " i could never prove that he makes money") I sent in the application for child support yesterday. I could care less if he pays me child support all that I ask in that event that je decides not to he relinquishes his parental rights, is that possible? If a judge decides not to go that route and continue to have him keep giving me child support what are the odds of it being increased, i mean who can maintain a child at $60.00 a week? Please let me know, thanks!
 
He cannot relinquish his parental rights. Has paternity been established? Whether he is working or not I believe he has to pay the ordered amount and if he doesn't then you notify the child support division. He can ask for and probably will receive visitation rights.
 
You cannot terminate his rights, it is not in the childs best interest to leave him without a legal father. You can certainly file for support. Hopefully enforcement can get him to pay. Hopefully you have a job, since you know Dad is giving you a hard time.
 
Paternity has never been legally established, he did sign the bith certificate though. The $240 a month he gives me is not court ordered so I think I would have to legally obtain an order before complaining about the last 5 weeks. My husband and myself are my sons full means of support since we can't count on "dad", which i neglected to mention is being taken to court also by the mother of his daughter for non-payment of child support as well.

hes not obligated to pay support untill a court orders him to do so. when he does, he wont have any choice but to pay, he wont get to decide he isnt going to support his child
