Our divorce was filed in Honolulu, HI: venue was changed to Las Vegas, NV (where he was stationed): now he lives in Sumter, SC.
My ex-husband and I met while we were both in the Air Force and married in 1995. After being married for almost 2 years I separated from the military to stay home with soon-to-be daughter. My ex-husband and I were divorced in October 2000. He took my name off of every account so that I had no access to 'his' funds then received $20,000 from his parents to file for divorce. He said that he was not going to pay for an attorney for me because he was going to give me custody after I 'got on my feet'. Within 30 days I had met all of his demands and he said he had changed his mind. Within 3 months he had met someone online and had her flown to Hawaii and in the meantime I was reentering the military so that I could hopefully gain enough income to retain an attorney in HI. Between 2001 and 2005 I attempted to gain custody by taking him to court 3 times as well as following him all over the country to be near my children but every time I got close he requested new orders. The third time was when he requested orders to Germany. This time the paperwork didn't make it to court. He said that if it went to court, I surely wouldn't win and he would mandate that I pay his attorney fees as well as sock me for all he could in child support.
Now here we are in 2008 and he is now in the same state as I am. He and his wife have, since the inception of their relationship, insisted my children call her mom. He introduces her as mom to all of their teachers and places her name on all of their paperwork as their mom and I am listed as a person who can pick them up. Considering all that has happened most of which I do not have the room to write here, I would understand if you think that I am trying to be petty thinking I may want revenge. However, although I am very hurt by all that has happened I simply want to hold on to every aspect of motherhood that I can considering our joint legal custody.
Do I have any right to have my name listed as the mom on the paperwork of my children at their respective schools? Does that right also include having my ex-husband's wife's name removed as their mom? Do I have the right to have the school contact me in case of an emergency if they can not contact my ex-husband, and not his wife?
