ex-employer ran a credit report

I recently obtained a credit report on myself and notice that an employer I left 4/3/08 had run an inquiry on me in July 2008. I'd love to send the owner a letter demanding that he remove it immediately and pay me damages suffered by having too many inquiries on my report. Would I be in the right?
 
I am currently trying to improve my score and I have learned from research I have done that my score is lower because of too many inquiries. I feel that this inquiry has somewhat contributed to my lower score. Besides, I think my ex-employer ran an illegal search which is against the law and punishable. I am just throwing my feelers out there to get some of your opinions. Thanks
 
Yeah-- he can get in trouble for pulling your report w. out your permission -- I would dispute the inquiry w/ the credit agency -- and send him a letter too. the agency will ask him to provide proof he had the right to pull it
