Entitled to counsel?

Is a person who has been commited at the hospital for suspected mental illness but instead released into a relative's care entitled to legal counsel? After all, personal liberty has still been stolen with no crime having been committed. If so, who should this person contact? Also, where can one find the legal requirements for a doctor making someone a ward of state?
