Employer mileage rate

They can pay at a lesser rate.

NOTE: CA and MA are the only states where the law requires that an employee be paid mileage at all; in neither state does the law require the full IRS rate; MA's reimbursement law is quite limited. And just to be sure it is absolutely clear since you did not specify what mileage you are talking about, there are no circumstances whatsoever, in any state including CA and MA, where the employer has to pay you mileage from home to your first stop of the day, or from your last stop of the day to home. It doesn't matter how many miles you travel or how long it takes you, your regular commute is NOT payable to you anywhere - this is black letter law.
