My son has a daughter with his former girlfriend. The girlfriend and daughter live in Arizona, but my son now lives in Georgia. The mother is on meth, and has not been home in 2 weeks. The baby is with the maternal grandmother. My son has acknowledged paternity by filling out forms when the baby was born. Can he go and get the baby and bring her to Georgia and file for emergency custody here?
 
He should probably file for emergency custody before he goes to pick up the child. That way that part is out of the way. So many loopholes in the system, it's better to CYA........
 
In AZ, he is recognized as the legal father if he filled out the birth paperwork. He legally should be able to pick up the child but if the maternal grandma refuses to hand him over, he'll have to file for emergency custody. He can talk to an attorney in AZ or file in the county that the child is in. It is much easier for dad to do this right and get an attorney ASAP.
