Does attorney duty of candor include enforcing due process, and can a attorney be considered culpable of incompetance or negligence for lack of diligence in a duty of candor if a delegated replacement attorney fails to summon a prisoner in custody of a jail during a calendar matter if cognizant the client is in custody thus inducing a warrant or violation of the defendant in a criminal matter? How about the district attorney, bailiff, or deputy sheriff? Would if be reasonable to assume their reasponsibility as far as liability?
