I recently got a dui in North Carolina. I was in the middle of no where (small time country roads). My drivers license is from Ohio. I admit I had a few beers, but my driving was perfect. The thing is, he pulled me over and said I crossed a double yellow line. I know this was a made up charge. I also refused the breathalizer test (because I had a few beers about an hour before and I did not know if it would show) So he sent me to jail overnight.
What I need to know is if I subpeana the dash cam of the police vehicle, and it shows I did not cross a double yellow line, will the case be thrown out of court because he had no probable cause to pull me over because my 4th amendment rights were violated.
I really, really need help on this. I know there is no evidince on his dashcam tape to prove this dui offense. I was just in a deserted small town at midnight and he was just looking to pull someone over.
