I got married in june 2010, and since then I am not having good terms with my husband. I gave birth to my daughter in feb11. My husband is a psychic case and fights with me in regular basis, he drinks a lot and daily. I am earning and staying at my company's accommodation i.e. I am not dependent on him on any matters, neither is he willing to share some money or work in home. He just want to fight all the time and plays all kinds of tactics against me along with his mother.I want advice form you what should i do and i am also scared that he will take my daughter away from me and fight with me after the divorce may be try to hurt me also. Please help me .

He has equal rights to your child as of right now.

Custody will be decided based upon the best interests of the child. A big question here though is who does what - in other words, are you both working?

If you work and Dad stays home, there's a better-than-decent chance he'll be the custodial parent with you having regular visitation.

If it's vice versa, just switch the terms.

One thing is for sure - you're going to have to deal with him having regular access to his child, and if he wants overnights and weekends they'll start more or less immediately (this assumes you'll be the CP).

i don't want my husband have any right on my child because he is not at all good father.

yes we both are working and currently i am staying at my company accommodation.

Thing is that i don't want to give him any accuses to my child , he is not at all good father and my child is not safe with him.

I pass my case to Blount County Alabama Divorce Attorney they are looking at my case.
I want best for my child and me also and i want to be the custodial parent for my child .

Why did you give the case to an Alabama attorney when you tell us that jurisdiction is in Arizona?

Here's the thing. You're married. You have basically told the court that he's fine parenting material, and unless there's something serious going on that you haven't told us about, he will get unsupervised visitation - and perhaps an equal time-share. You can't just change your mind overnight.

One other thing. I get that you're trying to help others and that's fine - but you posted incorrect information in that one bankruptcy thread. Please don't do that :)

I talk to my attorney about the case and i will get the justice and about bankruptcy thread i will make sure this will not happen again .

Your custody issue is a problem. Unless you can prove - and by prove, I mean police reports, convictions, etc - that he's unfit, Dad is going to get unsupervised visitation probably from the get-go.

You can make all sorts of claims, but the bottom line is that he's going to get some custody and it won't be supervised.

Again though, you said you lived in Arizona - why is an Alabama attorney looking at things?

This forum is by default take Arizona state i don't mention any state in this forum. I live in Alabama and my case is handle by my Blount County Alabama Child Custody Attorney. my friend told me about this forum site she is also facing some family issue so i join this forum and i am very much pleased by your answers. Thank you so much

One more thing i like to add in this topic can you suggest me how to handle Personal Injury case.

We don't have much information/details here. You might want to talk to a personal injury attorney.

Betty Thank you for your reply. Of course i will concern with Personal injury attorney but i thought may be you guys help me the way you do in past few days. Please help me with this also if you have any knowledge regarding Personal Injury do share with me .

I know the judge in BlountCo. You'll not get everything you want. Husband will get visitation at the very least.

If husband attempts to hurt you, you call the sheriff/911.

You say you have an attorney. Why not approach him/her with your questions and concerns? That's why you're paying for his/her services.

You can call the County and State Bar Association and see if they know of anyone who is willing to help you:

Law schools usually offer clinics for free help, to train the law students.

Here's a number for the Miles Law School; No information on their website if they offer clinics or such, but the worst they can do is tell you no.
