What do you do when your boss tells you-"If I get a call about giving a reference. I will tell them you drink and do drugs". I need to know what can I do? There was no witnesses to this statement. Do I have a legal foot to stand on with this statement. Another employee was told the same thing.
By this same person in our department.

Is there someone above your boss that you could complain to? Why would your boss say something like that? If this is a small company, you may have to resort to somethiing clever... or wait and see if it happens and then take action. Some people I have known have telephoned the person threatening them and recorded the call which was for the purpose of discussing the threat. I'm not sure whether this is lawful within your state. This is a tough situation and I sympathize but as there is no threat of violent action, I'm not sure what can be done.
