defamation?

My ex employer owes me for overtime. He also audio recorded secretly at work. When he denied my overtime, I said I would go to the labor board or file suit. He then blackmailed me and told me not to persue this issue. He was threatening a horrible rumor. Immediately I heard from two seperate employees who still work there, that he told them this rumor in front of other people. I am devistated and scared that this rumor has been started. Do I have a defamation case?
 
Defamation cases are hard to make……..There are certain elements and evidence which must be present. It also depends on his source, how accurate the source, and his ultimate intent. I would advice you call a civil lawyer for free initial consultation. They would guide you best and see all what you have as evidence, and if it meets the criteria. Most lawyers have free initial consultation………
 
My ex employer told people I had an affair with the manager and am pregnant. He also accused me of stealing, and smoking pot. I know these rumors are malicious. My ex employer told people that work with my husband and I am so affraid of how this will affect him... as we are already having marital problems (non-related). Can my ex employer get by with this? I have been having a problem finding an attorney that even does this type of case.

He also used information he learned through secretly audiotaping me and other employees. There has to be some law against audio recording with out consent or knowledge??? CALIFORNIA
 
What about small claims. How hard would it be to prove damamges. Is it the defendants burden to prove that these rumors are true? How do I prove they are not true?
