I have a 3 yr old daughter who does not carry my ex's last name due to the fact that he has been in and out of jail more times than i can count and the day i was giving birth was another day of him being in jail. I would like to file for child support but I'm afraid that if and when I do a judge will give us joint custody. He is a habitual crack addict and as much as I would like for him to give me some type of support I just can't have my daughter in that environment. What are my options? In the event child support is ordered what would happen since again my daughter does not carry his last name.

His mother though has been supporting her grand daughter eventhough we all know it's not mandatory and could stop at a minute.

HELP!!!
 
Paternity would have to be established before child support ordered. He would have the right to visitation and could ask for 50/50. Why rock the boat at this point if grandmother is helping with support? If she stops then reconsider your options at that time. If you pursue it she may stop helping.
 
you always risk the fact he is going to be granted some sort of visitation. It is unrealistic to expect him to hand over money at this point. He sounds like a loser who probably is not even employable. I agree, why rock teh boat? If paternity is established, he will likely have some rights, especially in the event something happens to you. Personally if I were you I would not want anything to do with him.
