I currently live in Md(for over a yr) my son's father lost his visitation rights in Jan 07. He lost themj because he repeatedly did not show up. At the time I was pregnant and had to bring my son all the way to nj for visits. I just found out that he is filing to re-instate his visitation and he also wants me to bring the child back to nj permantly. What can i do? I'm fine with the visitation, but will the courts actually force me to move my family back to nj? My husband is from md and is the sole provider of the family. Could they really make HIM move? shouldnt this case be handled in MD because we've lived here for over a yr? Please Help!

If he lost visitation rights it is highly unlikely you eill be forced to move back. He is though likely entitled to visitation and probably will get it reinstated but whoever has to provide the transportation to the visits is up to the courts to decide.

he is dad

this is not about your husband, its about YOUR SON. and dad's right to a relationship with him. seems to me you dont want your son to have a relationship with his father at all. and that is something that will not make a judge happy

I don't agree that it is necessarily bad to not want a child to have a relationship with his father. Sometimes the parent has nothing to offer the child other than more disappointments. But my loser ex moved away because he couldn't get a job here anymore because he is such a druggie. Then he had his visits stopped by the judge. Then, the the basis of 2 negative drug screens over a year, he got weekend visits and I have to provide transportation. Good luck.

The courts recognize that both parents have rights and that it is rarely in the childs best interests to not have a father involved. Unless he has abused the child then the courts will likely give him some visitation, even if its supervised.
